New bankruptcy reform act: Under the new bankruptcy law, although the eligibility requirements will be stricter, you, the consumer, may still be eligible for a fresh start under chapter 7 or a chapter 13 plan that only obligates you to pay a small percentage of your unsecured debt. Once the new bill is signed into law by President Bush, there will be a transition period, estimated to be six months, when you can still file under the old law. Filing under the old law will be beneficial to many people depending on their level of income and other factors. However, don't rule out the benefits of filing under the new law once an eligibility analysis is made. |
